This is kind of a long story sorry but I'll try to make it short.

About 2 to 2 1/2 years ago when I was having some housing issues. I had to find a new home for two of my pacman frogs, so a buddy of mine said he could keep them at his house for a while till I good place big enough to keep them, but I had to pay for all the supplies needed ect. (all he was offering was a space for the tank, I was doing all the work)

After a while of me comming by a few times a week to feed and clean, He tells Me He will be more than happy to feed them and even clean out there tank, but I would still have to pay for the supply.

I finally got My new home (no more renting). When I call My buddy up to tell him the good news and to set up a day to pick up my boys, he asks if He can keep the frogs at his house because his wife and and step son have fell in love with them. I didn't see a big deal with that saying he had them at his house for almost a year, but I said "If they ever get to be too much just call Me".

My two frogs later turned into two more, then some fish, and then a bird. He hung out at that pet shop so long, He even got a job there!

This is where it gets bad!!

I stopped by the pet shop today to pic up some mice, while I was waiting I started looking around at all the new herps when I spot My frogs! Not only was it My frogs, it was the whole set up on the shelf next to all the other frogs for sale! There was no price tag on the tank, but they sure look up for sale to Me!

My buddy was out today and I never talked to the owner about it. But what do I do? Do I just say there mine a take them back, or are they really his to sell after all this time?

It's not like a dumped them on His doorstep, He asked Me for them.

I don't know. I'm just a little pissed right now...

Talk to the pet store owner, get the story from him before they are sold! Ask what the intention is for the frogs. Maybe he will put a hold on them while you sort this out.

You might have a case if you can show that you were still paying for the care of them, that way he can't claim that you abandoned them or gave them to him.

Call a lawyer and see what your rights are, some law offices have a free consultation option.

It sucks when friends turn out to be JERKS! Talk to your buddy and see what's going on.

I left Him a message saying I stopped by the store today and He need to call me back.

I haven't paid for anything on those frogs for a year of so because He asked to keep them as his own for his step son. But I told Him that if they were too much for him to bring them back.

My guess is either His step son is tired of them or They started calling again.

Before you get too excited make sure that they are in fact for sale. I know at our local pet store they will board pets for people and the cages are out in the same areas as the other similar animals, though with either no tag or one saying not for sale.

Now IF he is trying to sell them, have you been supplying food etc this whole time or have you been allowing him to feed them? It will make a difference as if you have been paying for them it is certainly a boarding situation regardless of if he isn't paid.

<edit> I see you say you've paid nothing. That is not good in your favor, if there is a dispute they will likely side with him.

If you have any of the communications that would be a plus in your favor. When is the last time you had contact with him?

Legally you can't do anything because you said he could keep them for whatever reason. If he decides to sell them, it's all up to him. Now from an ethical/human being stand point, your friend is an a-hole and I would be doing all I could to get those frogs back. You told him to let you know if he wants to get rid of them, and he didn't, so he was probably looking to make a buck off of them, if they are in fact for sale and not for boarding like Ragdoll pointed out.

id just walk in and take them, . possesion is 9 tenths of the law. i doubt he would take you to court over a couple of frogs. dont do that thow even though i would especialy if hes not around.

Unless the pet shop payed more than $0.01... Even if they didn't... From a law state of view, you would be stealing them from the store. If you are unable to get the frogs back, I hope you learned that agreements are best on paper.

I went through about the samr thing about 4 years ago when a guy asked me to watch his dog while he was out of state for a few months, but hen never called and didn't come back for a year in a half and just asked for his dog back. When I told Him it wasen't hes dog anymore He took me to court! The judge said after 14 months of food boarding and vet bills, if He wanted the dog back it would cost Him three thousand dollars so We got to keep him.

This is not the point in this case. He said the frogs were for His step son! Not to power feed and make a profit on!

It's been 12 hours whit no call back, the last time I called the phone rang once then it stopped. Seems kinda fishy to Me. And when I called the pet shop and asked about the frogs the owner said they were 100 each or both for 175. At least I know they will be there for a while till I work this thing out.

The shop owner will still make out good because I will have to buy a new tank and set up for them.

Your best bet is to somehow get him to admit, via email or text that they are yours and that it was your agreement that they go back to you.

But, after a couple years, were you going to ever take them away from the kid? Did you assume eventually they would tire of them and give them back?

If it were me, I'd give them back, but I can see the flip side as well, how much money did he spend feeding and caring for them?

Keep us posted Jay.. Maybe just offer to buy them back from him, he did spend the time and money taken care of them, and if he is a true friend he will just give them back. You did say " If they ever get to be too much just call me"....And if they are sitting in a pet shop obviously his wife and kids don't care. I hope you guys don't lose a friendship over this. This should be an easy fix between friends. Or just take that money and buy yourself some new Babies and enjoy them. Tell your friend the way you feel and be done with him. It is a real crappy thing he did. Good Luck.

Apparently Ellen DeGeneres is going through the same thing with a dog now, but there was a written contract so I guess it's a little different.

And I'm still waiting on a call back from Judge Judy!!

On a good note, I talked to the shop owner and He said He's going put the frogs in the back room till We sort this thing out. His quote is "I didn't pay a dime for these frogs, but Florida law says that as long as there in My shop there mine!" But He also said He's not going to watch us get into a fist fight over "some turds with mouths"!

If I can ever get a hold of Mike I'm sure We can settel this, But I don't think theres going to be much of a friendship after this, and I may have to start using a different pet shop too.
